Operation Sol (Screenplay)

[shaggy]

Screen opens black and as the voice over goes on the screen opens to an abandoned playground on a small island. The camera glides over the ground showing much of the area around. There is a swing set, a couple picnic tables, and a tree. The rest is all open ground except for the small bridge that goes to the mainland.

Eunhathes (Voice-over): It all started back in high school one summer, we were bored and hot. Not a good combination when you are in the middle of Ohio. So we looked around and found a bunch of water guns. And I don’t mean the piss poor water guns you can pick up at for a dollar at your local grocery store. I am talking about CPS-1000, guns that hold about a gallon or more of water and shoots it at about 20 psi, a very powerful gun. And that my friend is the birth of Operation Sol…

The screen opens on a bunch of people sitting in the backyard of a house just talking. Shaggy is reclined on a hood of a car, Eunhathes is in a reclined position against the house, Antaeus is sitting on the steps, Ikari is playing with a dog a little to the side, and Artemi is reclined against the car. They all look bored as hell and the sun is just blaring down upon them.

Shaggy: Well, this is a lazy day.
Artemi: Yeah, but what are we going to do about it?
Antaeus: I got an idea. Shaggy pop your trunk.

Shaggy slides off the hood and climbs into the driver seat, the trunk pops open shortly after. Antaeus walks to the back of the car and removes two gigantic water cannons. He tosses one to Artemi.

Antaeus: We use these to have a little fun. Now I know we all love first person shooters since we have had so many LAN parties. So, let’s do our own live action FPS. We create a score board and get points for certain things. We have different types of play and do one every weekend. At the end of the summer we see who is the champion.
Eunhathes: I like it. But one question remains; what are the modes of play?
Antaeus: Well, I was thinking one of them could be a simple Team Elimination. You know, for the team that isn’t eliminated at the end of the round gets a point. Each player on the team receives a point.
Artemi: Well, I can tell most games are going to be team based. So how are we going to do this so it will be one person with the top points at the end of the summer, not an entire team?
Shaggy: How about we get a bunch of two different things. Like playing cards, have people draw and all the spades are a team and all the diamonds are a team.
Eunhathes: That works.
Artemi: How about a capture the flag as one of the modes of play?
Antaeus: Ok, but how will it work?
Ikari: I have an idea for that one.
Silence for a couple seconds.
Eunhathes: So, what’s your idea?
Ikari: Oh, ummm….. each team has a base and the other team has to get the flag out of the base. The flag has to be well known and seen easily. Like elimination one shot gets you out of the game, but unlike elimination you can “respawn” at your base by putting on a dry shirt. For the girls we will need a cover of some sort. To win the round you have to successfully get the other teams flag back to your base. If you are shot while in possession of a flag you drop it right there. I don’t know if you can carry your flag or not. What do you guys think?

§ 652C Appropriation of Name or Likeness
One who appropriates to his own use or benefit the name or likeness of another is subject to liability to the other for invasion of his privacy.

Comments:
a. The interest protected by the rule stated in this Section is the interest of the individual in the exclusive use of his own identity, in so far as it is represented by his name or likeness, and in so far as the use may be of benefit to him or to others. Although the protection of his personal feelings against mental distress is an important factor leading to a recognition of the rule, the right created by it is in the nature of a property right, for the exercise of which an exclusive license may be given to a third person, which will entitle the licensee to maintain an action to protect it.
b. How invaded. The common form of invasion of privacy under the rule here stated is the appropriation and use of the plaintiff's name or likeness to advertise the defendant's business or product (This has been expanded through the US Supreme Court to include the writings of books, scripts, articles, essays, and other forms of literary media), or for some similar commercial purpose. Apart from statute, however, the rule stated is not limited to commercial appropriation. It applies also when the defendant makes use of the plaintiff's name or likeness for his own purposes and benefit, even though the use is not a commercial one, and even though the benefit sought to be obtained is not a pecuniary one. Statutes in some states have, however, limited the liability to commercial uses of the name or likeness.

The character names will be changed. They are only there to show who I would like to play them. If you have a serious problem with this I will change it.

And it is only illegal if it becomes published. As of now it is not going to be published until discussions are over.

It is also legal if I say right now; All likeness and names are by coincident only.

But we all know that isn't true. Also it isn't illegal until the product is finished. Right now it is incomplete and can be claimed in a court of law that it is not shown of who the characters are. Also there are no last names as of yet. I could go on, but you sir jumped the gun and if you look at the bottom, everyone s far is a member of the group. So by law all of the names are allowed to be used.

I have said to Shaggy on THREE separate occasions that I do not want him to use any character of mine nor any resemblances, or a character based off of me in any way in any works that he does. This makes it FOUR. The name Lylie is unique in spelling. I want the name changed. It is a copyright law violation. It is being put up for public use for all to see, it could lead to people believing that Shaggy could actually make a character like Lylie. I think that the FIRST time should have been enough for Shaggy to learn that I do NOT want him to use MY characters. Apparently it takes four times to get through to him NOT to use these characters. Change the characters.

I would ask that we all remain calm here. Lylie, I understand that you do not wish to be involved in this thread... by way of name, likeness, or other defining attribute. That is your right.

Shaggy, in the name of being reasonable, I will ask you to eliminate Lylie's name from your original post and all posts hereafter in this thread. I do not mean change the spelling... I mean change the name fully to something that has nothing to do with her.

I cannot find evidence that Lylie's likeness has thus far been placed into the thread. Thus, there is no reason to change any words or actions from that character.

Again Shaggy, please remove her. She has expressed a full want to be separate from your writings.

Lylie has been removed and replaced with a completely fiction girl named Ikari. As of right now her nationality has not been made. A name is a name and does not give any clues to nationality. Since my optimum cast pick for that role has so eloquently declined there is now an open role for casting. But we don't have to worry about that for right now.

If any body else would not like to be cast or vice versa please speak up. I am taking this time to say that if no response is made and your name is used but you don't want it to be please ask me civilly to change it. I have no problem with editing.

Remember that if your name is used it is not because I expect you to be the role, it is just who I would like to see in the role. A lot of script writers already have a specific actor in mind when they make a role, most of the time. Also, if you do want to be cast I do not expect to use your real name or any alias as the character. We will change it to whatever you are comfortable with.

Another thing, sorry Lylie but if you recall I have not spoken to you in over a year probably going on two. Most of the small stuff, and I do call most of your complaints about me small, has been eradicated from my memory. I don't even remember what you sound like. So I am sorry that you have a better memory about all my faults.
